What Actually Has to Be in a Staff Handbook

No single piece of legislation lists the contents of a handbook. The law creates duties that have to be written down somewhere your staff can reach, and the handbook is where most employers put them. A working set covers ten areas:

  • Disciplinary rules, and the steps a disciplinary follows
  • How somebody raises a grievance, and who hears it
  • Sickness reporting, and what you pay when a person is off
  • Holiday, the leave year, and how requests get approved
  • Maternity, paternity, shared parental and adoption leave
  • Behaviour at work, and what happens when a complaint is made
  • Data protection, and what you do with employee records
  • Email, phones and social media
  • Expenses, and anything you take out of somebody's pay
  • Whistleblowing, and how a concern reaches someone other than a line manager

Some of that you have to write down. The rest is there because it settles an argument you would otherwise be having in front of a tribunal.

Where a Free Template Handbook Falls Apart

The trouble with a handbook off the internet is rarely the wording, which is normally fine. The trouble is that it describes somebody else's business. It might promise company sick pay you do not offer, a three stage disciplinary when you run two, or a notice period you never agreed. Whatever it promises, you can be held to it. Where it contradicts your contracts, that contradiction is the part that gets quoted back at you. A handbook nobody has checked against the contracts is worse than none at all, because it hands the other side something to read out.

Contractual or Not, and Why It Matters

A handbook can be contractual, non contractual, or a mixture of both, and downloaded ones almost never say which. It cuts both ways. Where the whole thing binds you, you cannot change a policy without agreement from every employee it covers. Go the other way, and none of it binds anybody, which makes a rule harder to lean on when you dismiss somebody for breaking it. The usual answer is a document that is non contractual by default, with the few clauses that genuinely need to bind marked as contractual and tied back to the contract. That is a call your advisor makes with you, once, near the start.

The Staff Data Policy Most Handbooks Miss

Every employer holds personal information about its staff, and rather a lot of it. Bank details, next of kin, sickness records, sometimes health information from an occupational health report. UK GDPR and the Data Protection Act 2018 expect you to tell staff what you hold, why you hold it and how long you keep it, and a staff privacy notice is normally where that lives. Downloaded handbooks either leave it out or carry a retention schedule written for a filing cabinet that is not yours.
