The Government has announced that an additional bank holiday will take place on Monday 19th September 2022, to mark Her Majesty Queen Elizabeth II’s State Funeral.
The same situation regarding contractual rights to bank holiday applies like it did with the recent bank holiday on 3rd June for the Queen’s Platinum Jubilee…
Your employees may be entitled to receive the additional bank holiday, depending on the wording of the employee’s contract of employment, see below:
- Employees are entitled to the extra bank holiday if their contract states “20 days holiday plus bank holidays”
- Employees are not entitled to the extra bank holiday if their contract states “20 days holiday plus 8 bank holidays (listed, or not listed but you =decide which ones are included in the 8)”
- Employees are not entitled to the extra bank holiday if their contract states “28 days or 5.6 weeks which includes bank holidays”
If the employee does not have the contractual right to receive the additional holiday, employers can still provide it as a gesture of goodwill or provide time off in lieu if it is not possible for the business to close.
If the employee will not receive the additional holiday, they can choose to request if off using their annual leave or take unpaid leave.
